1. Who we are and what these terms cover
1.1 Cyprus Film Crew is an online platform operated by KONIMO Productions LTD, a company registered in the Republic of Cyprus. The Platform helps film and media producers in Cyprus find crew members, equipment/rental vendors, and filming locations, and lets crew, vendors and location owners publish listings about themselves.
1.2 These Terms & Conditions ("Terms") are a legal agreement between you and KONIMO governing your access to and use of the Platform. By creating an account, claiming a listing, or otherwise using the Platform, you agree to these Terms. If you do not agree, do not use the Platform.
1.3 Our Privacy Policy (at /privacy) explains how we handle personal data and forms part of your agreement with us.
1.4 Nothing in these Terms excludes or limits your rights under mandatory Cyprus or EU law, including consumer-protection rights. Where these Terms conflict with a mandatory right you have, that right prevails.
2. What the Platform is — and is not
2.1 We are a venue and an introduction service, not a party to your dealings. KONIMO provides a platform where users publish and discover listings and make contact. We are not an employer, recruitment agency, talent agent, equipment hire company, letting agent, or party to any contract, engagement, booking, hire or transaction between users.
2.2 No guarantee of results. We do not guarantee that you will find crew, work, bookings, equipment, locations, responses, income, or any particular outcome from using the Platform.
2.3 We do not verify users or listings. While we operate an admin review and approval process and may suspend or remove accounts and listings, we do not guarantee the identity, credentials, qualifications, credits, right to work, insurance, licensing, or the accuracy of any information that users publish. You are responsible for carrying out your own checks and due diligence before engaging anyone or entering any transaction.
2.4 Dealings between users are between those users. Any agreement, booking, payment, rate, or engagement is a matter solely between the users involved. We are not responsible for the conduct, performance, or non-performance of any user, on or off the Platform.
3. Eligibility and accounts
3.1 You must be at least 18 years old and able to enter a binding contract to create an account.
3.2 You may register with an email address and password, or sign in using a third-party provider (currently Google) via OAuth. You are responsible for keeping your login credentials secure and for all activity under your account.
3.3 You must provide accurate, current information and keep it up to date. You may hold only one account per person or business unless we agree otherwise.
3.4 Roles. Accounts operate in one of the following roles: Producer, Crew member, Vendor (equipment), or an administrator role held by us. Some features depend on your role.
4. Directory listings and claiming
4.1 Seeded ("unclaimed") listings. Some listings on the Platform were created by us from publicly available sources to make the directory useful from day one. These are marked internally as unclaimed, and where we relied on a public source we record it. Unclaimed listings cannot be logged into and hold only limited information.
4.2 Claiming. If a listing describes you or your business, you may claim it by registering and verifying your connection to it. Once claimed, you control and are responsible for that listing's content.
4.3 Removal / objection. If you are the subject of an unclaimed listing and do not want to be listed, you may request its removal or object to the processing of your data. See §4 of the Privacy Policy for how we handle this (including the removal-requested state). We will action valid requests as described there.
5. Your content and the licence you give us
5.1 You own your content. "Your Content" means everything you submit or publish — profile details, bios, skills, experience and credits, gear lists, rates, availability, photographs and work galleries, CV/PDF documents, listing descriptions, images, messages, reviews, and any other material.
5.2 Licence to operate the Platform. You grant KONIMO a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, adapt (for formatting and display, e.g. generating image derivatives), publish, and display Your Content for the purposes of operating, providing, securing and promoting the Platform. This licence exists only so we can run the service; it is not a transfer of ownership.
5.3 Duration. The licence lasts while Your Content is on the Platform. When you delete Your Content or your account, the licence ends for future use, except that (a) we may retain copies as required by law or for backup/audit for a limited period, and (b) it does not apply to content others have already lawfully copied or shared.
5.4 Promotional use. We may feature public listings in marketing of the Platform. We will not use your image or words as a personal testimonial or endorsement without your separate consent, which you may withdraw.
5.5 Your promises about Your Content. You confirm that you own or have the rights to Your Content; that it is accurate and not misleading; that publishing it does not infringe anyone's rights (including intellectual-property, privacy, and image rights of people shown in photos); and that you have any consents needed from third parties depicted or named.
6. Acceptable use
6.1 You must not use the Platform to:
- (a) post content that is unlawful, defamatory, harassing, hateful, discriminatory, obscene, or that infringes anyone's intellectual-property, privacy or other rights;
- (b) impersonate any person or business, or misrepresent your identity, role, credentials or affiliation;
- (c) post false, misleading, or fraudulent listings, rates, credits or availability;
- (d) post a job, booking or engagement that breaches applicable law — including minimum-pay, non-discrimination, tax, health-and-safety, right-to-work and employment law;
- (e) send spam, chain messages, or unsolicited advertising, or use contact features for anything other than genuine Platform-related communication;
- (f) scrape, harvest, crawl, or bulk-download data or content, or use bots to access the Platform, except as expressly permitted;
- (g) attempt to bypass security, rate-limiting, or anti-bot measures, or probe, scan or test the vulnerability of the Platform without our written permission;
- (h) upload malware, or anything designed to disrupt or damage the Platform or its users;
- (i) use another user's contact details or content for any purpose other than the engagement they relate to.
6.2 Employers and job posters are solely responsible for ensuring their listings and engagements comply with all applicable laws, including pay, non-discrimination, tax and employment obligations.
6.3 We may remove content or suspend accounts that breach this section (see §9).
7. Bookings, contact and communications
7.1 The Platform may let users send booking/enquiry requests and messages relating to a listing. These features exist to help users make contact and agree terms directly. KONIMO is not a party to and does not administer, guarantee, or take payment for any booking or engagement.
7.2 Any figures (rates, day rates, budgets) shown or exchanged are indicative and set by users, not by us.
7.3 We may send you service-related communications (for example, account, security, booking and notification emails). Transactional email may be handled by a third-party provider on our behalf (see the Privacy Policy). Marketing emails, if any, are sent only with a lawful basis and you can opt out.
8. Reviews
8.1 Where the Platform allows reviews, they must be honest, based on genuine experience, and must not contain unlawful or abusive content. You are responsible for your reviews. We may remove reviews that breach these Terms but do not endorse or guarantee any review.
9. Suspension, removal and termination
9.1 We may remove or unpublish any content, and suspend or terminate any account, where we reasonably consider that you have breached these Terms or applicable law, or to protect the Platform or other users. Where we suspend an account, affected listings may be unpublished.
9.2 Where practicable and lawful, we will give you notice and a reason, and — for account suspensions — a means to respond. We keep an internal audit record of moderation and suspension actions.
9.3 You may stop using the Platform and delete your account at any time. Certain records may be retained as described in the Privacy Policy and §5.3.
9.4 Provisions that by their nature should survive termination (including §§5.3, 10, 11, 12, 13, 15, 16) continue to apply.
10. Intellectual property in the Platform
10.1 The Platform itself — its software, design, text, graphics, logos and branding (excluding Your Content and other users' content) — is owned by KONIMO or its licensors and is protected by intellectual-property law. We grant you a limited, personal, non-transferable, revocable licence to use the Platform in accordance with these Terms. You may not copy, modify, distribute, or create derivative works from the Platform except as permitted by law.
11. Third-party services and links
11.1 The Platform relies on third-party providers (for example hosting, database, storage, sign-in, anti-bot, analytics and error-monitoring services — see the Privacy Policy) and may link to third-party sites. We are not responsible for third-party sites or services, and your use of them is subject to their own terms.
12. Disclaimers and our liability
12.1 Widest permitted disclaimer of warranties. The Platform, and all content on it, is provided on an "as is", "as available" and "with all faults" basis. To the fullest extent permitted by law, KONIMO disclaims all warranties, conditions, representations and terms of any kind, whether express, implied or statutory — including any implied terms as to satisfactory quality, fitness for a particular purpose, accuracy, title, non-infringement, availability, security, or uninterrupted or error-free operation. We do not warrant that the Platform, any listing, credential, review or piece of information on it is accurate, current, lawful, or complete.
12.2 No liability for users, content, or dealings between users. To the fullest extent permitted by law, KONIMO is not liable for, and you release us from, any loss, damage, claim, injury or dispute arising out of or connected with: (a) the acts, omissions, content, conduct, identity, credentials, solvency, or performance or non-performance of any user; (b) any engagement, booking, hiring, payment, rate, contract or transaction between users; (c) your reliance on any listing, profile, credit, review or information on the Platform; (d) any meeting, communication, or in-person or on-set interaction arising from the Platform; or (e) any content that is unlawful, infringing, defamatory, or harmful posted by a user. You use the Platform, and deal with other users, entirely at your own risk.
12.3 Assumption of risk. You acknowledge that KONIMO is an introduction venue only (§2), does not vet users, and has no control over how users behave on or off the Platform. You knowingly and voluntarily assume all risks associated with using the Platform and with any engagement you enter as a result of it.
12.4 Mandatory carve-out (this always prevails). Nothing in these Terms excludes or limits our liability where it would be unlawful to do so — including liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for a breach of your non-excludable statutory consumer rights, for our obligations under data-protection law, or for any other liability that cannot lawfully be excluded or limited under Cyprus or EU law.
12.5 Cap on liability. Subject to §12.4, and to the fullest extent permitted by law, KONIMO's total aggregate liability to you arising out of or in connection with the Platform and these Terms (whether in contract, tort including negligence, statutory duty, or otherwise) is limited to EUR 100. Because the Platform is currently free to use and we take no payment from you, a fixed cap is used rather than a fees-based one.
12.6 Exclusion of indirect loss. Subject to §12.4, and to the fullest extent permitted by law, we are not liable for any indirect, incidental, special or consequential loss, or for any loss of profit, revenue, business, opportunity, contracts, goodwill, anticipated savings, reputation, or data, however arising.
12.7 Time bar. Subject to §12.4 and to any longer period that mandatory law guarantees you, any claim you bring against KONIMO arising out of or connected with the Platform must be commenced within one (1) year after the event giving rise to it, failing which it is permanently barred to the extent the law allows.
12.8 Consumers. If you are a consumer, §§12.1, 12.2, 12.5, 12.6 and 12.7 apply only so far as permitted by mandatory consumer-protection law and do not affect your statutory rights, your right to bring a claim in your home EU courts, or any limitation period that the law guarantees you. Where any of these provisions would be unfair or void against a consumer under that law, it is read down to the maximum protection the law permits and the remainder of the Terms stands (§16.2).
13. Indemnity and release
13.1 Indemnity. To the fullest extent permitted by law, you agree to indemnify and hold harmless KONIMO and its officers, employees and agents against all losses, damages, liabilities, claims and reasonable costs (including reasonable legal fees) arising out of or connected with: (a) your breach of these Terms or of any applicable law; (b) Your Content; (c) your use of the Platform; or (d) your dealings, engagements or disputes with any other user.
13.2 Consumers. If you are a consumer, §13.1 applies only to the extent permitted by mandatory consumer-protection law — in practice, a consumer is responsible only for loss caused by their own breach or fault, and is not liable beyond that. It does not reduce your statutory rights.
13.3 Release of user-to-user claims. To the fullest extent permitted by law, any dispute between you and another user is solely between those users, and you release KONIMO (and waive any claim against us) in respect of it. This does not affect any claim you may have against us for our own breach of these Terms or of a duty we owe you that cannot be excluded by law.
14. Changes to the Platform and these Terms
14.1 We may update the Platform and these Terms from time to time — for example to reflect new features, legal changes, or security improvements. We will post the updated Terms with a new "last updated" date and, for material changes, take reasonable steps to notify registered users. Your continued use after changes take effect means you accept them. If you do not accept a material change, you may stop using the Platform and delete your account.
15. Governing law and disputes
15.1 These Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes) are governed by the law of the Republic of Cyprus.
15.2 The courts of the Republic of Cyprus have jurisdiction over any dispute. If you are a consumer, this does not deprive you of the protection of the mandatory rules, or the right to bring proceedings in the courts, of the EU country where you are habitually resident.
15.3 Complaints first. Please contact us in writing at our registered address above, or through the Platform, so we can try to resolve any issue directly. Consumers in the EU may also use the European Commission's Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr.
16. General
16.1 Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and KONIMO regarding the Platform.
16.2 Severability. If any provision is found unenforceable, the rest remain in force.
16.3 No waiver. Our not enforcing a right is not a waiver of it.
16.4 Assignment. You may not transfer your rights under these Terms without our consent. We may transfer ours in connection with a reorganisation, merger or sale, without reducing your rights.
16.5 No third-party rights, except as required by mandatory law.
